Benewah County District Court Overview

Benewah County is in Idaho's First Judicial District, which includes Benewah, Bonner, Boundary, Kootenai, and Shoshone Counties. Idaho's hierarchy is the Idaho Supreme Court, Idaho Court of Appeals, District Courts, and the Magistrate Division of the District Courts. The magistrate division is inside the District Court. It is not a separate municipal or justice court structure like some other states use. Benewah County's court page lists District Judge Barbara Duggan and Magistrate Judge Rachel Hamilton.

The District Court is the main Idaho trial court for felony trials, higher-value civil cases, appeals from magistrate decisions, and judicial review of some government actions. The magistrate division handles traffic and infractions, misdemeanors, felony preliminary hearings, small claims, civil cases up to $10,000, evictions, probate, guardianship, conservatorship, juvenile cases, divorce, custody, and other family-law matters. That division split is the key to knowing where a Benewah County court record begins.

Benewah County District Court vs Magistrate

Idaho's structure does not use a county court or justice of the peace court for Benewah County trial matters. The useful comparison is the District Court judge level, the magistrate division, and federal court when a case belongs outside Idaho's state system. Municipal ordinance and city-law enforcement cases route into the state magistrate system rather than a separate municipal court found in some states.

Benewah County District Court Case Flow

Criminal and civil cases can move through more than one level in the same District Court structure. Felony prosecutions may start with magistrate first appearances and preliminary-hearing functions. If probable cause is found, the case moves to a district judge for later felony proceedings. Civil cases may begin in the magistrate division or district judge level depending on amount and case type. Magistrate decisions can be appealed within the district-court structure before any state appellate review.

Civil flow: Claim or complaint › answer › motions › hearing or trial › judgment › collection or satisfaction › appeal when allowed.

Probate and family flow: Petition › notice and response › hearing › order › review, modification, or closing when the case type requires it.
